USA – Increase in OPA 90 Limits of Liability (23 March 2023)

The U.S. Oil Pollution Act 1990 (OPA 90) provides for an adjustment of the limits of liability according to increase in Consumer Price Index (CPI). On 23 December 2022, the United States Coast Guard published a final rule to increase limits of liability for vessels under OPA 90. The new limits of liability, which came into effective on 23 March 2023, are as follows:

The greater of USD2,500 per GT or USD21,521,000.
b) Tank Vessel less than or equal to 3,000GT:
・Single-Hull Tanker
The greater of USD3,700 per GT or USD7,478,800.

・Double-Hull Tanker
The greater of USD2,300 per GT or USD4,985,900.
b) Tank Vessel less than or equal to 3,000GT:
・Single-Hull Tanker
The greater of USD4,000 per GT or USD8,070,400.

・Double-Hull Tanker
The greater of USD2,500 per GT or USD5,380,300.
c) Any Other Vessel:
The greater of USD1,200 per GT or USD997,100.
c) Any Other Vessel:
The greater of USD1,300 per GT or USD1,076,000.
